Job Description

The primary purpose of this position is to provide legal counsel, advice and support to KeyBank National Association’s Residential Mortgage line of business, with primary focus on its residential mortgage loan servicing and foreclosure activities. Amongst others, this person will work closely with various members of the bank’s Mortgage Loan Servicing, Foreclosure, and Compliance departments.

Major Functions:
  • Provide legal advice to residential lending business on residential mortgage loan servicing and foreclosure activities and objectives (e.g. mortgage payments, statements, hazard insurance, credit reporting, discharges, foreclosure activities, etc.).
  • Support and be the main point of contact for the legal needs of the residential mortgage loan servicing and foreclosure departments.
  • Work cooperatively with the Compliance department to advise the company on all aspects of laws and regulations applicable to residential mortgage loan servicing and foreclosure activities.
  • Draft and review forms, disclosures and agreements for use by residential mortgage loan servicing and foreclosure departments.
  • Review and respond to regulatory and customer complaints.
  • Partner with other legal staff and lending units on enterprise level operational issues and projects.
  • Ensure compliance monitoring and internal controls are in place, including processes for management of operational risk, in accordance with Company and regulatory standards.
  • Review vendor contracts and advise of any regulatory or legal concerns related to KeyBank’s Mortgage business.
  • Retain and manage outside counsel, as needed and appropriate, to address various KeyBank’s Mortgage issues and needs.
  • Conduct research on legal matters impacting KeyBank’s Mortgage business, including state and federal statutes and regulations.

Required Education and Experience
  • Legal research, Lexis
  • Proficiency with personal computers
  • Strong working knowledge of applicable federal and state banking regulations including TILA, RESPA, FDCPA, FCRA and UDAAP.
  • Proven ability to define legal issues and evaluate legal risks
  • Juris Doctorate from an accredited law school and admission to the New York or Ohio State Bar required.
  • Minimum of 5 years of legal experience combining corporate legal and private law settings including significant experience with matters pertaining to residential servicing, foreclosure or consumer finance law.
  • Experience working with all levels of business units, outside counsel, regulators, and compliance
